Terms of Use for Quietude

1. Agreement to Terms
By downloading, installing, and using the Quietude App ("the App"), you agree to be bound by these Terms of Use ("Agreement"). If you do not agree to these terms, do not install or use the App.
This Agreement is entered into between you ("User") and Ilia Usatov ("Developer"). By using the App, you also acknowledge that payments and subscriptions are processed through Apple Inc. ("Apple") and we utilize RevenueCat for subscription infrastructure.
2. License and Permitted Use
2.1 License Grant
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for your personal, non-commercial use on devices you own or control.
2.2 Restrictions on Use
You agree NOT to:
- Copy, modify, or create derivative works based on the App
- Sell, lease, or sublicense the App
- Reverse-engineer, decompile, or disassemble the App
- Use the App for unlawful purposes or solely to record/monitor others without consent
3. In-App Purchases and Subscriptions
3.1 Subscription Options
The App offers optional in-app subscriptions ("Quietude Pro") and a lifetime purchase option to unlock premium features:
- Monthly Subscription: Renewable monthly.
- Annual Subscription: Renewable annually.
- Lifetime Purchase: One-time payment for perpetual access (does not auto-renew).
3.2 Billing and Auto-Renewal Terms
IMPORTANT INFORMATION ABOUT AUTO-RENEWING SUBSCRIPTIONS:
- Payment Processor: All payments are processed exclusively through Apple's StoreKit. We use RevenueCat to validate these transactions.
- Automatic Renewal: Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Charges: Your Apple ID account will be charged at confirmation of purchase and for renewable within 24 hours prior to the end of the current period.
- Management: You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Settings > Subscriptions > Quietude. This is the only way to cancel a subscription.
- Free Trials: Any unused portion of a free trial (if offered) will be forfeited when you purchase a subscription.
3.3 Refunds
Refund requests are handled exclusively by Apple in accordance with their App Store policies. The Developer cannot issue refunds directly.
4. Health and Medical Disclaimer
4.1 Not a Medical Device
IMPORTANT: Quietude is NOT a medical device.
- It is not intended to diagnose, treat, cure, or prevent any hearing loss, tinnitus, or other medical condition.
- The "decibel meter" function is for productivity and environmental awareness only. It is not calibrated for industrial safety compliance (OSHA/NIOSH standards) or medical audiology.
4.2 Consultation
Always consult with a qualified healthcare provider regarding any hearing or health concerns. Do not rely on the App for medical advice.
5. Intellectual Property Rights
All content, design, code, graphics, and intellectual property in the App are owned by or licensed to the Developer.
6. Warranty Disclaimer and Limitation of Liability
6.1 No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. The Developer disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
6.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR any indirect, incidental, special, or consequential damages rising from your use of the App, including loss of data.

Please see the Quietude Privacy Policy for a complete explanation of our data handling practices, including our commitment to not record audio and our use of local data storage.
8. Modifications to Terms
The Developer reserves the right to modify these Terms at any time. Your continued use of the App constitutes acceptance of the updated Terms.
